Human diversity – in the variety of biological issues, the envi- ronment, and social processes – requires constant attention to the variation of things, which are always in motion. Even the le- gal system, necessarily formalized, envisions strategies in judg- ments to adjust the application of the law to the specific case. Furthermore, it requires frequent readjustments, whether due to the emergence of new situations or the realization that cer- tain rules are misguided or lead to injustice. This is what drives legislative activity in the structures of the Rule of Law. * Society is not simply the result of a set of articulated so- cial institutions. Society is also – and perhaps above all – struc- tured by processes (which we will bring together under the notion of circulation) that traverse these institutions, and the social fields, in differentiated ways – generating rearrangements in the articulated diversity, through actions of strain, social criticism and invention, to face new problems and provide continuity to common actions. Admittedly, this circulation is far from perfect – it involves differences in access and opportunities, discrimination, oppression, violence, and a whole range of misunderstandings, injustices, and barriers to civilization. Nonetheless, a minimally viable society implies an intense circulation of actions and dis- courses across different contexts. This capillarization promotes combinations of diversity, always variable. We thus observe “evolutionary” cultural processes that continually generate vari- ations (social diversification) and perform selections (seeking articulation, compositions, and stability). Society is a composition of compositions (see Braga, 2023). Varied compositions offer, simultaneously, conditions for interaction in diversity; maintenance of sufficient variation to address social problems with some specific acuity; and the capacity for adjustable selections, based on flexible strategies.
